Dinsmore & Shohl LLP’s Environmental Law Practice Group represents clients before federal, state and local regulatory agencies and in federal and state administrative, civil, and criminal environmental litigation matters throughout the United States. This includes representing companies in Superfund and Toxic Tort litigation in which the firm has taken a lead role in forming and managing Potentially Responsible Party Groups to defend or prosecute cost recovery actions pertaining to Superfund sites and to defend against multi-party and class action plaintiff toxic tort litigation.

Compliance Counseling
Our attorneys counsel clients in compliance requirements under local, state, and federal environmental statutes and regulations. This can include obtaining the necessary environmental permits, negotiating compliance plans or permit terms and conditions with regulatory agencies, and responding to citizen’s group challenges. We also provide legal advice and opinions in real estate and business transactions as well as Brownfield development efforts.

Auditing
Dinsmore & Shohl LLP conducts audits to apprise clients of non-compliance areas with applicable environmental laws and regulations. We then assist in developing a plan that will bring a client into compliance and suggest future improvements.

Audits begin with a systematic review of a client’s industrial process. Each process is evaluated separately for compliance and permit requirements. Actual process input and output limitations also are compared to permit limitations and actual or potential impact to environmental media. Recommendations are made for meeting all local, state, and federal environmental laws and regulations. The audit carries the confidentiality of having been prepared by an attorney, provides the best opportunity to resist disclosure of the audit findings in a subsequent litigation setting. Additionally, the client is free to disclose the existence of the auditing system, to mitigate threatened criminal, civil, or administrative penalties.
